Even though it is stricter than the Google in the selection of apps, the Apple is being processed for allowing the presence of illegal gambling in App Store. This is not the first time that something like this has happened to the company, in 2018 more than 25 thousand applications were removed from the platform precisely because of this.
It turns out that the process understands that the Apple did little to prevent the return of these types of games to its store after the mass removal. The lawsuit is filed by Joshua McDonald and Michael Helsel, who claim they lost money to illegal games on the App Store. The lawsuit is filed in the United States District Court for the Northern District of California and accuses Apple to profit from, promote and facilitate illegal gambling on their devices, operating as an irregular casino.

In the action, the authors argue that the Cupertino giant not only allows these services to be available, but also indicates these games for users. "THE Apple The App Store drives 50% of all app installs. Of that total, about 21% of installs come from users who discover and install apps by browsing featured apps or sifting through app categories,” the lawsuit reads in part.
The lawsuit also names a specific developer, DoubleU Games Co., which creates roulette-style games with virtual casino tables and the like. The games initially have a number of free coins (which would theoretically make them a non-cash game), but then start charging players to continue. The lawsuit claims that this is a way to deceive the consumer.
“Developers and the Apple have several options for monetizing an app, including the Freemium model, which is used by Apple and the applications developed by DoubleU that are the subject of this process,” says another passage.
“In the Freemium model, consumers can download the app for free (i.e., apps in the Free to Play tab), but consumers are provided with optional additional features within the app that require payments (i.e., In-App Purchases),” it adds, saying that Apple provides the payment system for these illegal gambling games.
