Since August of last year, Epic Games and Apple have been fighting a legal battle caused by Fortnite removal from the App Store. Last time, the court ordered the presence of Tim Cook and Craig Federighi as witnesses. The process is still ongoing, and now, Tim Cook (Apple) and Tim Sweeney (Fortnite) will come face to face in court.

Apple takes a position on the case

There are two versions of the case, Epic accuses Apple for anticompetitive and monopolistic practices in relation to payments. On the other hand, the Apple reports Epic's breach of contract to increase its revenue. In a statement to the Tech Runch, Apple spoke about the incident and declared:

“Our senior executives look forward to sharing with the court the very positive impact the App Store has had on innovation, economies around the world, and the customer experience over the past 12 years. We are confident that the case will prove that Epic purposefully violated its agreement solely to increase its revenue, which resulted in its removal from the App Store. In doing so, Epic circumvented the App Store’s security features in a way that would lead to reduced competition and put consumer privacy and data security at tremendous risk.”

Other witnesses called to testify

In addition to Tim Cook and Tim Sweeney, the list of witnesses includes executives from both companies who will testify in court. Among them are the aforementioned Craig Federighi and Phil Schiller (both from Apple) and Mark Rein (from Epic Games). This list also includes names of members of Microsoft, Facebook and NVIDIA.

Finally, the beginning of this trial between Apple and Epic Games is scheduled for 03/05. Remembering that In Australia, the developer of Fortnite sued Google, alleging anti-competitive conduct that violates consumer laws.
